The Consumer Protection - Distance Selling

Our Terms and Conditions - continued
You may be aware that the law sets out a number of rules for internet retailers. The Regulations came into effect on 31/10/2000 and were updated on 06/04/2005. They relate to the purchase of goods or services where there is no face-to-face contact, such as by mail order, over the internet, by fax or by telephone. Here, at Gourmet World, we wish our customers pleasurable, trouble-free shopping and we also wish to ensure that our customers are fully aware of their rights, what they are purchasing, with whom they are dealing with and conditions of sale etc. For ease of understanding, we have simplified the regulations in providing the following information. However, should you have any doubt whatsoever, please do not hesitate to contact our customer services, either by email: info@thegourmetworld.com, or by telephone: +44(0)1202 471133, or by fax: +44(0)1202 471123.

Making A Contract With Us
When you place an order, we will treat this as an offer to buy goods and a contract has been made between us, unless, in the unlikely event, that the goods are no longer available or that we have made a pricing mistake, we will advise you of this within 4 hours by email and there will be no contract between us. All monies will be refunded immediately.

How to Order
The home page displays the categories of goods and services on offer. By clicking on the desired category you will be shown the products, product information and prices etc., within that category. You select which product/s you require, they will automatically be placed in your online shopping basket. This activity is called shopping. If you need to review what is in your shopping basket or wish to cancel any item go to “basket”.

When your shopping is complete, go to checkout, which will ask for details regarding Billing Address and Delivery Address or whether you are a Club Gourmet member. Having completed this section you click on “submit”, which takes you through to your itemised Bill. You are asked to confirm your details and agree purchases etc., the next screen lists once again your details and items in shopping basket are shown. You are asked whether you wish to pay for what you have chosen or cancel. Throughout this process, up to this point, you can cancel at any stage. Should you wish to accept your shopping bill and pay select PAY, which takes you through to an independent third party: Secure Trading, who handle the processing of your credit card details etc. and executed the payment process. At no time are your credit card details, in any form, available to the Gourmet World, therefore ensuring total customer security. In the unlikely event that the goods are no longer available, we will advise you of this within four hours by email and there will be no contract between us. All monies will be refunded immediately.

Goods will be despatched in accordance with terms for despatched – should you have any questions regarding this process or need help in the actual activity of shopping, please do not hesitate to contact customer services (on telephone: +44(0)1202 471133, fax: +44(0)1202 471123 or email: info@thegourmetworld.com).

Cancellation, Returns & Refunds
This cancellation policy does not affect your rights when we are at fault – for example if the goods are not as described.

This policy does not apply to the following goods, which are exempt from the right to cancel:
1. Any product that is specifically produced to meet your order;
2. Any product that is specifically produced to your specification;
3. Any product that we deem is exempt from the right to cancel as stated in the product description;
4. Any product that has a shelf-life of less than a week from time of despatch.

You can cancel your contract before delivery and up to 7 working days after the day following delivery. To do this please email us, telephone or fax but do not write to us, as the post can delay any action we might have to take. We will refund your money including any original postage charges etc. within 30days.

You do not have to give any reason for cancellation; however, a brief explanation will help the Gourmet World improve the service we offer to our customers in the future.

If you cancel, you must return the goods to us at your own expense. You are responsible for the risk of loss or damage when you return goods, so you should take out postal insurance to cover their value.

If you fail to return the goods, we will collect them and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us and this results in damage or deterioration, we will charge you for the reduction in value.

Faulty Goods
If you have any problem with the goods, please contact us to discuss the matter further.

Changes to these Terms
These terms and conditions apply to your order and constitute the contract between us. We may change our terms and conditions at any time, so do not assume that the same terms will apply to further orders.

Previous versions of our standard terms and conditions can be viewed see below.

Matters Outside of Our Control
If, due to matters outside of our control and which we could not reasonably have foreseen, we cannot fulfil our contractual obligations, our maximum liability to you will be a full refund of any monies paid.
